Case Studies Responses to the following case studies are limited to two typewritten double-spaced pages. Explain an appropriate response by the public employer to each of the following situations. Case Study 1: The fire commissioner learns that a newly hired fire cadet is pregnant. The pregnancy was not detected during the mandatory pre-entry medical examination. The cadet is in the third week of a sixteen-week state mandated firefighter certification course. Substantial risks of harm exist for the cadet and her unborn child if she is allowed to continue the training. If she does not complete the training, she cannot be certified as a firefighter. Case Study 2: The state of Wisconsin prohibited employment discrimination on the basis of an individual criminal history. The criminal history must be related to the position applied for by the individual. Wisconsin law restricts who can drive buses that transport school children. Members of the media reported that a bus driver transporting school children has a ten-year-old criminal conviction involving sexual relations with a fourteen-year old. Yielding to pressure from the public and the local school board superintendent, the bus company fired the driver. Evaluate Wisconsin law on employment discrimination on the basis of criminal history and the restriction placed on some criminal offenders who are bus drivers. Case Study 3: Ron B has been a police officer for ten years. Recently, the department has been receiving complaints that Officer B is discourteous with members of the public. A review of Officer B’s personnel file reveals that he has received five citizen complaints for making uncalled for remarks, rudeness, and other inappropriate statements to members of the public within six months. There were no prior complaints. It was easy to correlate the beginning of the rude behavior to the time that Officer B requested a family medical leave to resolve family issues. His request was denied because it did not comply with the guidelines of FMLA. Is Officer B disabled? Case Study 4: Karen applies for an executive assistant position to the VP of her bank. She strongly feels that she has all the qualifications for the positions and meet all the requirements detailed in the position posting. Karen is surprised to learn that a newly hired employee at the bank got the promotion. Karen learns from friends that the new hire has less time and did not meet the substantial qualifications of the postings. Karen approaches her immediate supervisor Carl and requests a meeting. In the meeting Carl informs her that she did not get the position because she was married. He explained that the VP desired someone who would be able to attend functions in town and out of town.
