Case briefing is a critical skill in the development of reading and understanding law. Indeed,
being able to synthesize the important elements of a case is foundational in developing,
synthesizing and applying the law to new facts; much of legal argument is comparing and
contrasting the current case from past cases. Plus, modern legal training embraces the “case
method” to learning (learning the law from reading judicial cases).
Thus, this assignment requires you to “brief” a case. Briefing a case means distilling the case into
its elements—the facts, the procedural history, the issue, the rule of law, the holding, and the
rationale.
INSTRUCTIONS
For each Case Brief Assignment, choose the most influential and interesting case from the
reading and write a one-page brief (at least 500 words—but these are to be “brief”, i.e., longer
isn’t necessarily better).
You must include the following sections:
Caption: the Bluebook citation for the case;
Facts: the main and relevant facts of the case;
Procedural history: how the case worked through the judicial system;
Issue: what specific issue is the court being asked to resolve/decide;
Rule of law: what rule of law does the court use to answer the issue;
Holding: how does the court apply the rule to the issue in the case given the facts; and
Rationale: why did the court decide the result it did

verify that all components of the assignment have been completed. Case brief must be formatted
according to current Bluebook formatting standards.
