Contract Lesson 3- Consideration (Continued) – Bargain Promises Discussion

Direction: This is a two parts assignment which consist of three discussion questions, and three peer discussion posts reviews. Under common law, “mutuality of obligation” was required for a bilateral contract. Draft an example of “a bilateral contract with mutuality of obligation”.
The Uniform Commercial Code (UCC) has deemphasized consideration for some types of contracts, such as a modification of a contract. Why do you think that the UCC has done this?
As a general rule, payment of an amount that is less than what is actually owed is not consideration for a full discharge of an obligation. However, there are many exceptions. Choose one of these exceptions and argue why it should be an exception.
